Use of samples and sample data obtained via the CIGMR Biobank website is subject to the following terms and conditions. Should you have any questions please contact us.
Definitions
Data means all and any human data obtained via the registered users’ area of CIGMR Biobank website.
Data Subject means a person, irrespective of state of health, to whom Data refers and who has been informed of the purpose for which the Data is held and has given his/her informed consent thereto.
Registered User means a researcher who has completed this Registration Form for access to the registered users’ area of the CIGMR Biobank website and has received a username and password from the CIGMR Biobank Administrator.
CIGMR Biobank means the organisation comprising individuals whose collections of DNA samples are held in its archive and the individuals responsible for this archive.
CIGMR Biobank receives core funding from the Medical Research Council and is administered from the Centre for Integrated Medical Research in the University of Manchester.
CIGMR Biobank Technical Committee means the committee appointed by the Medical Research Council to oversee access to data and materials accessible through CIGMR Biobank.

Purpose
The Registered User agrees to use Data only for the advancement of medical research, according to the consent obtained from sample donors.
Confidentiality
The Registered User agrees to preserve, at all times, the confidentiality of information and Data pertaining to identifiable Data Subjects. In particular, the Registered User undertakes not to use, or attempt to use the Data to deliberately compromise or otherwise infringe the confidentiality of information on Data Subjects and their right to privacy.
Data Protection
The Registered User agrees that they are covered either individually, or through their host institution, by the UK Data Protection Act 1998 as amended from time to time or equivalent legislation outside the UK, and understand their duties under it in relation in particular to use and the rights of Data Subjects.
Access and Governance
The Registered User agrees not to give access to Data, in whole or part, or any identifiable material derived from the Data, to others, except Registered Users. The CIGMR Biobank Technical Committee reserves the right to request and inspect data security and management documentation to ensure the adequacy of data protection measures in countries that have no national laws comparable to that pertaining in the United Kingdom. Currently UK law only recognises the national data protection laws of the EAA (the 15 EU members plus Iceland, Liechtenstein and Norway), and those of Switzerland and Hungary.
Data reissue
The Registered User accepts that data will be reissued from time to time, with suitable versioning. If the reissue is at the request of sample donors and/or other ethical scrutiny, the Registered User will destroy earlier versions of the Data.
Publications
The Registered User agrees to acknowledge CIGMR Biobank in any work based in whole or part on use of the registered users’ area of the CIGMR Biobank website. The acknowledgement should state: “We acknowledge services and data access provided by CIGMR Biobank administered from the Centre for Integrated Genomic Medical Research (University of Manchester)”. The Registered User further agrees to forward promptly to the CIGMR Biobank Administrator three copies of all published work arising from use of the registered users’ area.
Termination of agreement
The Registered User agrees that this agreement will terminate immediately upon any breach by the Registered User of this agreement or of the Acceptable Use requirements of JANET. The Registered User accepts that the changing ethical framework of human genetic research may lead to alteration to the terms of this agreement or its withdrawal in extreme circumstances. The Registered User further agrees that this agreement will terminate immediately upon any breach by the Registered User of the terms of any other agreement (in particular a Materials Transfer Agreement) to which the Registered User and CIGMR Biobank are parties.
Information about the Registered User
The Registered User agrees that information supplied on this form may be copied and stored by CIGMR Biobank. The Registered User agrees that information supplied on this form may, after anonymisation, be used by CIGMR Biobank to help attain the aims and objectives of CIGMR Biobank.
Legal statement
The Registered User agrees that CIGMR Biobank, the original data creators, depositors or copyright holders, or the funders of the Data or any part of the Data supplied bear no legal responsibility for their accuracy or comprehensiveness. They also accept no liability for indirect, consequential, or incidental, damages or losses arising from use of the Data, or from the unavailability of, or break in access to, the service, for whatever reason. The Registered User understands that all the Data is protected by copyright and other intellectual property rights, such that duplication or sale of all or part of the Data on any media is not permitted.
Governing Law
This agreement shall be construed, interpreted and governed by the laws of England and Wales and shall be subject to the non exclusive jurisdiction of the English courts.
